These Terms & Conditions apply to the services provided by FCS (“we”, “us”, “our” or “the Company”) to our customers (“you”, “your” or “the Customer”).
By accepting a quotation, booking our services, confirming an appointment, or otherwise instructing us to carry out work, you agree to these Terms & Conditions.
These Terms & Conditions should be read alongside our Privacy Policy, which explains how we collect, use and protect personal information submitted through our website and contact forms.
1. About Us
FCS provides exterior cleaning services to domestic and commercial customers in the United Kingdom.
Our services may include:
Pressure washing and exterior surface cleaning
Driveway and patio cleaning
Tarmac cleaning
Block paving cleaning
Concrete cleaning
Pathway and hard-surface cleaning
Render cleaning
Gutter cleaning
Window cleaning
Other exterior cleaning services agreed with the Customer
The exact services provided will depend on the quotation or agreement made with the Customer.
2. Quotations and Estimates
2.1. Where requested, we may provide a quotation or estimate for the proposed work.
2.2. Unless expressly stated otherwise, quotations are based on the information available to us at the time of quoting and on the condition and accessibility of the property or surfaces as reasonably understood.
2.3. Where a quotation is based on photographs, videos, measurements or information supplied by the Customer, the final price may need to be reviewed if the actual condition, size, accessibility or requirements of the work differ materially from the information provided.
2.4. If additional work is identified after the commencement of a job, we will explain the additional work and any additional charges before carrying it out wherever reasonably possible.
2.5. No additional charge will be made for additional work that has not been agreed with the Customer, except where the additional work is necessary to address an immediate safety issue or prevent damage and it is not reasonably practicable to obtain prior approval.
2.6. Quotations are valid for the period stated on the quotation. If no validity period is stated, we reserve the right to review the quotation if circumstances or costs materially change before the work is accepted.
2.7. A quotation does not constitute a binding contract until it has been accepted by the Customer and the booking or work has been confirmed.
3. Booking and Acceptance
3.1. A booking may be accepted by telephone, email, text message, online communication or another method agreed between FCS and the Customer.
3.2. A contract for services will be formed when the Customer accepts our quotation or otherwise confirms that they wish us to carry out the agreed work.
3.3. The scope of work will be based on the quotation, booking confirmation or other agreement made between FCS and the Customer.
3.4. Where there is a difference between these Terms & Conditions and a specific written quotation or agreement, the specific written quotation or agreement will take precedence to the extent of the inconsistency.
4. Prices and Payment
4.1. The price payable for the work will be the price agreed in the quotation or booking confirmation, subject to any additional work or changes agreed in accordance with these Terms & Conditions.
4.2. Unless otherwise agreed, payment is due upon completion of the work.
4.3. We may accept payment by the methods we make available to the Customer.
4.4. Where a deposit or advance payment is requested, the amount and purpose of the payment will be communicated to the Customer before payment is made.
4.5. Any deposit or advance payment will be handled fairly and in accordance with applicable consumer law.
4.6. If payment is not made when due, we may request payment before carrying out any further work for the Customer.
4.7. Nothing in these Terms & Conditions affects the Customer’s statutory rights.
5. Cancellation and Rescheduling by the Customer
5.1. If you need to cancel or reschedule an appointment, please contact FCS as soon as reasonably possible.
5.2. We understand that circumstances can change. Where a Customer cancels or reschedules, we will seek to act reasonably and fairly.
5.3. If a cancellation results in costs or losses to FCS, we may seek to recover reasonable costs or losses directly resulting from the cancellation where permitted by law. Any such charge will be reasonable and proportionate to our actual loss.
5.4. We will take reasonable steps to minimise any loss caused by a cancellation, including seeking to fill the appointment where possible.
5.5. We will not automatically treat all deposits or advance payments as non-refundable in every circumstance. Any refund or deduction will be considered in accordance with the circumstances of the cancellation and applicable law.
5.6. Where the Customer has a statutory right to cancel a contract, these rights will apply in addition to these Terms & Conditions.
6. Statutory Cancellation Rights
6.1. Depending on how and where a contract is agreed, consumers may have statutory cancellation rights under applicable UK consumer law.
6.2. Where a statutory 14-day cancellation period applies, the Customer may have the right to cancel the contract without giving a reason during that period.
6.3. If the Customer asks us to begin providing services during an applicable cancellation period, the Customer may be required to pay a reasonable amount for services supplied up to the point of cancellation, where permitted by law.
6.4. Where the service has been fully performed within the applicable cancellation period following the Customer’s express request and acknowledgement of the consequences, the Customer’s statutory right to cancel may end where the law permits.
6.5. Nothing in these Terms & Conditions is intended to remove or restrict any statutory cancellation rights that cannot legally be excluded.
6.6. Where a statutory cancellation right applies, we will provide any legally required cancellation information and cancellation method.
7. Cancellation or Rescheduling by FCS
7.1. We may need to cancel or reschedule an appointment due to circumstances outside our reasonable control, including:
Severe or unsuitable weather conditions
High winds, heavy rain, freezing conditions or other unsafe weather
Equipment failure
Staff illness or unexpected absence
Health and safety concerns
Unsafe access conditions
Unexpected property or surface conditions
Water supply or electrical supply issues
Other circumstances beyond our reasonable control
7.2. Where reasonably possible, we will contact the Customer as soon as we become aware that an appointment needs to be changed.
7.3. We will make reasonable efforts to rearrange the work at a mutually convenient time.
7.4. If FCS cancels a contract and the Customer has paid in advance for work that has not been carried out, any refund due will be handled in accordance with the circumstances and applicable law.
8. Weather Conditions
8.1. Exterior cleaning work can be affected by weather conditions.
8.2. We may postpone or reschedule work where weather conditions make the work unsafe, impractical or likely to materially affect the quality of the result.
8.3. This may include heavy rain, freezing temperatures, high winds, storms or other adverse conditions.
8.4. We will aim to provide reasonable notice when weather conditions require an appointment to be rearranged.
9. Access to the Property
9.1. The Customer must ensure that FCS has safe and reasonable access to the areas where the agreed work is to be carried out.
9.2. The Customer is responsible for informing us of any relevant access restrictions, parking restrictions, locked gates, security systems or other matters that may affect access.
9.3. Where access is not available at the agreed time and this prevents us from carrying out the work, we may need to reschedule the appointment.
9.4. If additional costs or losses are incurred because agreed access is unavailable, we may seek to recover reasonable costs directly resulting from the issue, where permitted by law.
10. Water and Electricity
10.1. Unless otherwise agreed, the Customer may be required to provide reasonable access to a suitable water supply and, where necessary, a suitable electricity supply.
10.2. If a suitable water or electricity supply is not available, this may affect the services we can provide.
10.3. The Customer should inform FCS in advance if there are restrictions on the use of water or electricity at the property.
10.4. Where alternative arrangements are possible, any additional costs will be discussed with the Customer before they are incurred wherever reasonably practicable.
11. Condition of Surfaces and Property
11.1. Exterior cleaning can improve the appearance of surfaces, but we cannot guarantee that every stain, mark, discolouration, organic growth or other imperfection will be completely removed.
11.2. Results may vary depending on:
The age and condition of the surface
Existing staining
Previous cleaning or treatment
Surface porosity
Weathering
Biological growth
Paint, coatings or sealants
The type and quality of the original materials
Previous repairs or alterations
11.3. Some stains and marks may be permanent or may require specialist treatment beyond the agreed scope of work.
11.4. We will use reasonable care and skill when carrying out our services.
11.5. Where we identify a risk that a surface or material may be damaged by the proposed cleaning method, we may recommend an alternative method or decline to carry out the work.
11.6. The Customer should inform us before work begins of any known defects, weaknesses, damage, loose materials, previous repairs or other conditions that may affect the work.
12. Pressure Washing and Surface Cleaning
12.1. Pressure washing involves the use of water pressure and, where appropriate, cleaning products or treatments.
12.2. Some surfaces may be unsuitable for pressure washing or may require a lower-pressure or alternative cleaning method.
12.3. FCS will use a cleaning method that we consider reasonably appropriate for the surface and agreed work.
12.4. The Customer acknowledges that certain surfaces may have pre-existing weaknesses or defects that are not visible before cleaning.
12.5. Cleaning may reveal existing cracks, loose areas, damaged pointing, deteriorated coatings, weakened surfaces or other defects that were previously obscured by dirt, algae, moss or other contamination.
12.6. We are not responsible for pre-existing defects or deterioration that become visible during or after cleaning, provided that the damage was not caused by our failure to exercise reasonable care and skill.
13. Render Cleaning
13.1. Render and coated surfaces can vary significantly in composition, age and condition.
13.2. Cleaning methods and results will depend on the type and condition of the render or coating.
13.3. FCS will use reasonable care and skill when cleaning render.
13.4. Where the condition or type of render presents a significant risk of damage, we may recommend an alternative treatment or decline to carry out the work.
13.5. We cannot guarantee complete removal of all staining or discolouration where marks are permanent, deeply embedded or caused by underlying issues.
14. Gutter Cleaning
14.1. Gutter cleaning is intended to remove accessible debris and blockages from gutters and, where agreed, associated downpipes.
14.2. We will use reasonable care and skill when carrying out gutter cleaning.
14.3. Guttering, brackets, joints and associated components may have pre-existing damage, deterioration or weaknesses.
14.4. We are not responsible for pre-existing defects or failures that were not caused by our negligence or failure to exercise reasonable care and skill.
14.5. If we identify a significant issue with the guttering during the work, we will inform the Customer where reasonably possible.
15. Window Cleaning
15.1. Window cleaning will be carried out using the method agreed or considered appropriate for the property and windows.
15.2. We cannot guarantee the removal of permanent marks, scratches, paint, hard-water staining, damaged seals or other defects that cannot reasonably be removed through normal cleaning.
15.3. We are not responsible for pre-existing scratches, cracks, damaged seals, defective frames or other pre-existing defects.
16. Cleaning Products and Treatments
16.1. Where appropriate, we may use cleaning solutions, detergents or treatments as part of the agreed service.
16.2. We will take reasonable care when selecting and applying products.
16.3. The Customer must inform us before work begins of any known sensitivities, restrictions, water features, ponds, delicate plants, animals or other property features that may be affected by cleaning products.
16.4. The Customer is responsible for removing or protecting personal belongings and items that could reasonably be affected by the cleaning process unless otherwise agreed.
17. Plants, Gardens and Outdoor Items
17.1. The Customer should inform FCS of any particularly sensitive plants, garden features, outdoor furniture, ornaments, electrical equipment or other items located near the work area.
17.2. We will take reasonable care to minimise the risk of damage to surrounding areas.
17.3. The Customer should move or secure fragile or valuable items before work begins where reasonably practicable.
17.4. Where an item cannot reasonably be moved or protected, the Customer should inform us before work starts.
18. Customer Responsibilities
The Customer agrees to:
Provide accurate information when requesting a quotation
Provide safe and reasonable access to the property
Inform us of known defects or risks affecting the work
Inform us of any relevant restrictions or special requirements
Provide access to agreed water or electricity supplies where required
Remove or secure fragile or valuable items where reasonably practicable
Keep children and pets away from active work areas
Follow reasonable safety instructions provided by FCS
Make payment when due
19. Health and Safety
19.1. FCS will take reasonable steps to carry out work safely.
19.2. We may refuse to carry out work or may stop work where we reasonably believe that conditions are unsafe.
19.3. This may include unsafe access, unstable surfaces, dangerous weather conditions, hazardous materials, exposed electrical hazards or other circumstances that present an unacceptable risk.
19.4. Where work is stopped for safety reasons, we will explain the reason to the Customer where reasonably possible and, where appropriate, discuss whether the work can be safely rescheduled.
20. Damage and Liability
20.1. FCS will carry out services with reasonable care and skill.
20.2. Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.
20.3. Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
20.4. FCS is not responsible for loss or damage caused by:
Pre-existing defects or deterioration
Defective, fragile or unsuitable materials
Hidden structural defects
Incorrect information supplied by the Customer
Failure by the Customer to disclose known risks or defects
Items left in or around the work area that the Customer was reasonably expected to remove or protect
Circumstances outside our reasonable control
20.5. This clause does not affect the Customer’s statutory rights or any rights arising from our failure to provide the service with reasonable care and skill.
21. Complaints and Remedial Work
21.1. We want our customers to be satisfied with the services we provide.
21.2. If you are unhappy with any aspect of our work, please contact us as soon as reasonably possible and explain the issue.
21.3. Where appropriate, we may inspect the work and, if the service has not been provided in accordance with the agreement or with reasonable care and skill, we will seek to put the matter right in accordance with applicable law.
21.4. Customers should give FCS a reasonable opportunity to inspect and, where appropriate, remedy any issue before arranging for another contractor to carry out remedial work, except where immediate action is reasonably necessary to prevent further damage or address a safety issue.
21.5. Nothing in this section limits or removes any statutory rights the Customer may have.
22. Photographs and Marketing
22.1. FCS may take photographs of completed work for business records, quality control and evidence of the services provided.
22.2. We will not use photographs in a way that identifies the Customer or reveals personal information without appropriate permission.
22.3. Where we wish to use photographs of completed work for marketing, advertising, social media or promotional purposes, we will seek the appropriate permission where required.
22.4. Customers may contact us if they have questions about the use of photographs.
23. Privacy and Personal Information
23.1. FCS may collect personal information such as names, email addresses and telephone numbers when customers contact us or submit information through our website.
23.2. Personal information will be handled in accordance with our Privacy Policy and applicable data protection law.
23.3. Our Privacy Policy explains what information we collect, why we collect it, how we use it and how customers can exercise their data protection rights.
24. Website Information
24.1. We aim to ensure that the information displayed on our website is accurate and up to date.
24.2. Photographs displayed on the website may show examples of our work and are intended for illustrative purposes.
24.3. Results may vary depending on the condition and characteristics of each property and surface.
24.4. Website content may be updated from time to time.
24.5. Nothing on our website is intended to override the terms of a specific quotation or agreement entered into with a Customer.
25. Intellectual Property
25.1. Unless otherwise stated, the content of the FCS website, including text, branding, logos, graphics and original images, belongs to FCS or is used with permission.
25.2. Website content may not be copied, reproduced, modified or used commercially without prior written permission, except where permitted by law.
26. Events Outside Our Reasonable Control
26.1. FCS will not be responsible for delays or failure to perform caused by circumstances beyond our reasonable control.
26.2. Such circumstances may include severe weather, flooding, storms, fire, equipment failure, utility interruptions, road closures, government action, serious illness, accidents or other circumstances that could not reasonably have been prevented.
26.3. Where such circumstances occur, we will take reasonable steps to minimise disruption and, where possible, rearrange affected work.
27. Changes to These Terms & Conditions
27.1. We may update these Terms & Conditions from time to time.
27.2. The version in force at the time a contract is entered into will generally apply to that contract, unless a change is required by law or agreed with the Customer.
27.3. The date of the latest update will be displayed at the top of this page.
28. Governing Law and Jurisdiction
28.1. These Terms & Conditions are governed by the law of England and Wales.
28.2. Where a dispute cannot be resolved informally, the courts of England and Wales will have jurisdiction, subject to any mandatory legal rights that apply to the Customer.
28.3. Nothing in these Terms & Conditions prevents a Customer from exercising any statutory rights available to them.
29. Your Statutory Rights
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
Where services are supplied to a consumer, applicable consumer law may provide rights including the right for services to be carried out with reasonable care and skill and, where appropriate, remedies if the service does not conform to the contract.
